Welcome to Transformational Tones LLC (“Transformational Tones,” “we,” “our,” or “us”). By accessing or using our website, services, AI tools, consultations, programs, memberships, class packs, or any offerings, you agree to the following Terms & Conditions, Privacy, and Waivers.

1. Services Provided

Transformational Tones offers: - Coaching programs, digital courses, and workshops - Sound therapy sessions, meditation, spa-like experiences, and movement classes (e.g., yoga, Pilates) at our studios - AI assisted customer support and consultation services - Memberships, class packs, and drop-in sessions

We may modify, update, or discontinue services at any time without notice.

2. Use of AI Communication Tools

Transformational Tones uses AI-powered systems, including: - Chatbots and automated messaging - AI SMS communication - AI voice calls for support or follow-ups - Scheduling and qualification automation

By interacting with our services, you consent to communication via AI systems. AI interactions may be recorded or reviewed for quality, training, or compliance purposes.

You may opt-out at any time by replying “STOP” to SMS messages or contacting us directly.

3. Eligibility

You must:

  • Be at least 18 years old

  • Have the authority to make decisions regarding program or session enrollment

  • Provide accurate and truthful information

4. User Responsibilities

You agree to:

  • Provide accurate personal and payment information

  • Use our services responsibly and ethically

  • Not interfere with AI systems or attempt to reverse engineer them

5. Program & Studio Services

All coaching, courses, sound therapy, spa-like sessions, movement classes, memberships, class packs, drop-ins, and program materials are for educational or wellness purposes only.

Important:

  • Sound therapy, meditation, movement classes and spa services are not a substitute for medical or psychological care

  • Any health-related advice or practices are provided for general wellness

  • You participate in studio sessions at your own risk

Transformational Tones does not guarantee specific results; outcomes depend on individual effort, engagement, and personal conditions.

6. Memberships & Packages

6.1 Unlimited Monthly Membership

  • Price: $333/month, auto-renews monthly

  • Cancellation: Cancel anytime; cancellation takes effect at the end of the current billing cycle; no refunds or prorated credits

  • Booking: Book through Mindbody or CRM; 24-hour cancellation required; unlimited members are not charged late/no-show fees

  • Access: Unlimited scheduled classes, including movement classes; members-only discounts on events, workshops, retreats

  • Waiver: Participation subject to Transformational Tones Liability Waiver (see Section 8)

6.2 Unlimited Annual Membership

  • Price: $2,222/year, auto-renews every 12 months

  • Cancellation: Cancel anytime; cancellation takes effect at end of current 12-month term; no refunds or prorated credits

  • Booking: Book through Mindbody or CRM; 24-hour cancellation required; unlimited members are not charged late/no-show fees

  • Access: Unlimited scheduled classes, including movement classes; members-only discounts on events, workshops, retreats

  • Waiver: Participation subject to Transformational Tones Liability Waiver (see Section 8)

6.3 5-Class Pack

  • Price: One-time purchase of $160

  • Expiration: 6 months from purchase

  • Booking: Book through Mindbody or CRM; 24-hour cancellation required; late cancellations or noshows result in loss of class credit

  • Access: 5 class credits for scheduled in-studio classes, including movement classes

  • Waiver: Participation subject to Transformational Tones Liability Waiver (see Section 8)

6.4 Single Class Drop-In

  • Price: One-time purchase of $160

  • Expiration: 6 months from purchase

  • Booking: Book through Mindbody or CRM; 24-hour cancellation required; late cancellations or no-shows result in loss of class credit

  • Access: One scheduled in-studio class, including movement classes

  • Waiver: Participation subject to Transformational Tones Liability Waiver (see Section 8)

7. Payment & Billing

  • Payments may be processed via Mindbody, CRM form payments, online store, or checkout systems.

  • All credit card and payment information is collected and processed in accordance with our Privacy Policy.

  • Automatic renewals apply to Monthly and Annual Memberships only.

  • One-time products (5-Class Pack, Single Class Drop-In) are non-recurring.

  • Electronic Acceptance: By completing a purchase through Mindbody, CRM, or store/checkout system, you confirm that you have read, understood, and agreed to these Terms, including liability waivers, and authorize Transformational Tones to charge your payment method accordingly.

8. Liability Waiver & Assumption of Risk

Participation in sound therapy, movement classes, workshops, and related activities involves inherent risks, including physical injury, emotional response, or discomfort. You voluntarily assume all such risks.

To the fullest extent permitted by New York law, you waive, release, and hold harmless Transformational Tones LLC, its owners, members, managers, employees, instructors, contractors, and agents from any and all claims arising out of or related to participation, except where caused by gross negligence or willful misconduct.

9. Waiver Acceptance (Mindbody, CRM, Checkout)

  • Mindbody: By clicking “Agree” during checkout, you accept all Terms, Waivers, and Policies.

  • CRM form payments / Store / Checkout: By submitting payment or electronic form, you confirm that you have read, understood, and agreed to all Terms, Waivers, and Policies. This electronic acceptance constitutes a legally binding agreement under New York law.

10. Health & Medical Disclaimer

  • Transformational Tones does not provide medical, psychological, or therapeutic advice.

  • Classes, workshops, movement classes, and other services are not a substitute for professional medical or mental health care.

  • Consult a qualified healthcare provider prior to participation if you have any medical conditions or concerns.

11. Photo & Media Release

By participating, you grant Transformational Tones LLC permission to photograph, video record, or otherwise capture your likeness during classes or events for promotional, marketing, or educational purposes, unless you provide written notice opting out prior to participation.

12. Limitation of Liability

Transformational Tones is not liable for: - Errors in AI-generated responses - Interruptions, delays, or errors

in services - Injuries or adverse effects related to spa, sound therapy, or movement classes - Indirect, incidental, or consequential damages - Use of AI communication tools, in-studio services, or any purchased products is at your own risk.

13. Third-Party Services

We may integrate third-party services for hosting, payments, or wellness program delivery. Transformational Tones is not responsible for third-party actions but partners only with trusted providers.

14. Force Majeure

Transformational Tones shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, weather events, power outages, public health emergencies, government orders, labor disputes, or facility issues. No refunds shall be issued for such events.

15. Privacy

Personal information is collected, used, and stored in accordance with Transformational Tones Privacy Policy. Payment and personal data collected via Mindbody, CRM, or checkout are handled securely. Clients may opt out of marketing communications according to the Privacy Policy.

16. Governing Law

This Agreement, including all Terms, Waivers, and Policies, shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.

17. Changes to Terms

We may update these Terms at any time. Continued use of our services constitutes acceptance of updated terms.
